Dear Mrs Rutherford,

 

 

I am reasonable sure that you may not be aware of the following events, but as chief executive you are not only responsible for your company but also the action(s) of your staff.

 

I have become aware through a member of your staff that Business Link for London East has  been promoting “Tendering for Contracts” workshops and other events to its clients for over twelve (12) months.

 

I wish to make you aware that I have been in contact with Business Link London East for approximately four (4) years trying to promote the programme “Tendering for Contracts” which I have developed as a business and from which I had expected to earn an income.

 

I also wish to inform you that I have been a registered consultant with the various Business Links, and subsequently with the newly reformed Business Links, and have discussed the benefits of this programme  with all business links throughout the UK since 1998.

 

I have developed the programme in late 1997, as a direct result of incidents which led to the failure of my previous business start-up attempt involving West London TEC, and successfully piloted the programme four (4) times since 1998.

 

I am a registered consultant with the SBS, including Business Link London East, as well as trying to get normal consultancy work, it is has been my intention to exploit the develop the programme “Tendering for Contracts” as a business venture.

 

I supplied the “Tendering for Contracts” documents to VJ Baker on the advice of Gail Williams who I had met at the University of Greenwich conference and exhibition, I was subsequently informed that my documents had been passed on Ruth Bothwell.

 

I subsequently contacted Ruth Bothwell, and she informed that because of the fact that the Business Links had been re-organised they were not yet at the stage where they could consider a programme such as mine and when that time came, I would be informed.

 

I was therefore extremely surprised and angry to learn from your staff that you were promoting “Tendering for Contracts” as a Business Link product and deriving revenues form the process, whereas I can’t get work and can’t get any interest in my “Tendering for Contracts” programme.

 

This is of course not surprising, I have called Ruth Bothwell on several occasion and she has not returned any of my calls,  I have left several messages on her answer phone, still no reply.

 

This is fact not a beach of my copyright, it is a denial of my right to life, (a) I am registered with your organisation and can’t get any work from them (b) the only other possible source from which I could reasonably expect to derive an income has been stolen by your organisation and passed of your own.

 

I therefore have no alternative, quite apart form the documentary evidence conforming that I did supply my “Tendering for Contracts” documents to Business Link London East, in attempt to gain their support, and subsequently as a direct of the fact that Business Link London east has passed off the concept and contents of these documents as their own creation and derived benefits in the form of revenue from such an action, I am therefore obliged to inform you of the following:-

 

(a)   You, your company, your employees and associates by your action(s) of offering “Tendering for Contracts” support services to firms and deriving revenues or other benefits, are in serious breach of my copyright, based on my documents previously supplied to Business Link London East,

 

(b)   by presenting the programme “Tendering for Contracts” et al as the property of Business

      Link and obtaining

 

(b1) financial remuneration and

(b2) public funds to exploit this project.

(b3) other business benefits

(b4) indirect revenues

 

(c)    I wish to advise you that it is my intention to issue an injunction against you, Business Link

      London East, your staff and all who may have unwittingly or otherwise assisted in the

      dissemination of the “Tendering for Contracts” programme/project,

 

(d)   further to this injunction I request that you supply me immediate with full details of all incomes/public or private funds/remuneration/disbursement/profits/ et al  or including any other financial reward(s) that you or your employers or associates or company may have received as a result of your promotion of the “Tendering for Contracts” programme/project.

 

(e)  I also request that immediately inform all associated Business Links, of which you are the Chief Executive, that the program/workshop training project “Tendering for Contracts” is the copyrighted property of Centre for Business Excellence Ltd and that all documents supplied by Centre for Business Excellence Ltd to Business Links, remain the copyrighted property of Centre for Business Excellence Ltd.

 

The documents requested includes both audited and un-audited accounts.

 

The above demands are in accordance with UK Law and are issued without prejudice, I therefore  expect full compliance to this request within (7) seven days from the date of this letter. 

 

I remain committed conditions of my registration with the BS as a consultant, Under the terms of the Equal Opportunities and Inclusion and Participation laws and government directives, I fully expect to obtain work in the areas in which my expertise merits and equally, I look forward to working with and through the Business Links in the area of providing my services to small firms.
