Lloyd Sewell vs Patricia Anne McNeil Joanne Schwencke –
Witness Statement Cranleigh, That this
statement confirm that I am an investing partner in the company "Tendering
for Contracts Training Ltd" which is owned by the Claimant
- Lloyd Sewell. I wish to
confirm; a) that as an
investor in the proposed project, I have been a party to all the discussions
and negotiations that have been conducted with
Defendant, Anne McNeil. c) that Defendant
was paid £2875,00 by checque on the project as
stipulated in Defendant's contract document dated, d) that the
payment made to Defendant under the terms of her contract were not changed or
varied in any way these were total
cost £11,500, made up as follows; 25% up front as a deposit 25% after the
foundations of the project were agreed, 25% on completion and 25% on final
acceptance of the project. e) that no part
of the proposed project was ever completed by Defendant - under the terms of
her contract f) that Defendant
did not insist that as a condition to completing the project, that Claimant was
required to sign a contract with a
third party. g) that as an
investor in the projecton10-Dec-2005, I travelled with Claimant to discuss the
final project details, including project
delivery date with Defendant. h) that as a
party to the discussions with Defendant and her associate, the Defendant at
that time did not insist that Claimant was
required to sign a contract with any third party prior to completing the
project. i) that Defendant
refused to complete any part of the project - and refused to repay the deposit I confirm that
